I.C. REMARKS OF THE CHAIR

The Palm Beach County, Florida, Board of County Commissioners (BCC) has convened to hear and consider public comments, pursuant to Chapter 163, Part II, Florida Statutes, Chapters 9J-5 and 9J-11, Florida Administrative Code, and other authority, on the transmittal of Comprehensive Plan Amendment Round 00-1. This public hearing is being held on Monday, May 8, 2000, at the Jane M. Thompson Memorial Chambers, sixth floor, 301 North Olive Avenue, West Palm Beach, Florida. This public hearing may be continued to another time and place as necessary.

The proposed amendments to the 1989 Palm Beach County Comprehensive Plan include text amendments and site specific amendments to the Future Land Use Atlas. Adoption of the transmitted amendments by the BCC will be in September 2000.

The Local Planning Agency (LPA) held its public hearings on these amendments on March 11, 17, 24, and April 24, 2000.

Planning Director Frank M. Duke informed the Board that staff wished to delete the following items from the Agenda: Items II.C.8., II.D.1. (Exhibit 1 Paragraphs 2, 33, and 34 only), II.E.5., and II.E.8. Those items that staff is able to finish work on will be brought back in Amendment Round 2000-2 in July 2000.

MOTION to DELETE Items II.C.8., II.D.1. (Exhibit 1 Paragraphs 2, 33, and 34 only), II.E.5., and II.E.8. from the Agenda. Motion by Commissioner Masilotti and seconded by Commissioner Marcus.

II.E.2. 45TH STREET CRALLS

AMENDMENT TO THE TRANSPORTATION ELEMENT OF THE COMPREHENSIVE PLAN TO ADD LANGUAGE ESTABLISHING SEGMENTS AND INTERSECTIONS ALONG 45TH STREET AS CONSTRAINED ROADWAY AT LOWER LEVEL OF SERVICE (CRALLS) FACILITIES. (P.O.P. 664602) APPROVED TRANSMITTAL 5-8-2000

PUBLIC COMMENT:

Town of Mangonia Park Mayor Alan Palmer spoke in favor of the proposed amendment, which is required to accommodate the Arena Complex proposed for the former Jai-Alai Fronton site on 45th Street immediately east of Congress Avenue. He said that town officials and staff had met with the developer Henrietta Corporation several times, he himself having met often with Don King. Mr. Palmer commented that the project had the enthusiastic support of both residents and Town Council. Amendments to the town's comprehensive plan had been transmitted to the Florida Department of Community Affairs in order to provide a Commercial-Recreational use district for the arena. The location of the TriRail station would be a great asset in that much vehicular traffic would be removed from 45th Street. Another great plus, he said, was that the Arena Complex would be privately funded.

City of West Palm Beach Deputy Planning, Zoning and Building Director Charles Wu told the Board that while the city wished to encourage redevelopment of the Jai-Alai Fronton site, the City Commission had expressed serious concerns about the application at its meeting the previous Monday. The city would like to reserve the right to comment and/or object to the application until more data and analysis was available to determine any negative impacts on residential neighborhoods to the south of 45th Street. Further, the city had scheduled a workshop for May 18, 2000, at 4:00 p.m. in order to allow Henrietta Corporation and the applicant to provide additional data and analysis. Mr. Wu added that the city looked forward to continued dialogue and coordination between Mangonia Park, Palm Beach County, Henrietta Corporation, and itself on this issue.

MOTION to transmit the proposed 45th Street CRALLS amendment. Motion by Commissioner Masilotti and seconded by Commissioner Aaronson.

Mr. Wu told Commissioner Aaronson that the city was worried about possible cut-through traffic from neighborhoods to the south and the length of time needed by residents to access 45th Street during peak hours of events at the arena. Mr. Aaronson observed that the city did not have many problems with several other projects that would heavily impact traffic.

Commissioner McCarty said she thought the entire Board was very supportive of this private enterprise.

Commissioner Masilotti praised the Arena Complex for the employment opportunities it would offer, the tax base it would create, the revitalization it offered to an area that had suffered tremendously over the last six years since the closing of the Jai-Alai Fronton, and for the many events it would feature that youngsters had not had an opportunity to see since the City of West Palm Beach had sold the Arena.

Commissioner Aaronson described the Arena Complex as a "wonderful project" that would offer not only boxing and wrestling but family entertainment as well.

Commissioner Newell welcomed the upcoming West Palm Beach workshop.

II.A. PRIVATELY INITIATED SITE SPECIFIC AMENDMENTS TO THE FUTURE LAND USE ATLAS

II.A.1. APPLICATION 2000-21 RES 1

AMENDMENT TO THE FUTURE LAND USE ATLAS ON THE 13.99-ACRE PROPERTY LOCATED ON THE NORTH SIDE OF DONALD ROSS ROAD, APPROXIMATELY 0.25 MILE WEST OF PALMWOOD ROAD (COMMON NAME: GAETA; OWNER/APPLICANT: NEIL J. Staff Recommendation: Transmittal with the condition that the development be limited to a maximum of 31 single-family dwelling units.

Principal Planner Kathleen Girard commented that staff had been contacted by residents in the Waterway Manor subdivision, expressing concern about the increased density and multifamily housing. The Town of Jupiter had written that it did not object to the amendment provided the density did not exceed approximately 2.2 units per acre. Ms. Girard said that the applicant had agreed to the staff-recommended condition.

MOTION to transmit the proposed Gaeta amendment with condition. Motion by Commissioner McCarty and seconded by Commissioner Marcus.

PUBLIC COMMENT: None

Commissioner Masilotti objected to the applicant's intention to withdraw from the amendment process once certain changes are made to the Unified Land Development Code.

II.A.2. AMENDMENT 2000-85 MLU 1

AMENDMENT TO THE FUTURE LAND USE ATLAS ON THE 40.0-ACRE PROPERTY LOCATED AT THE NORTHWEST CORNER OF THE FUTURE EXTENSION OF LYONS ROAD AND HYPOLUXO ROAD (COMMON NAME: WINDSOR PLACE; OWNER/APPLICANT: DESARROLLOS XENABAL LIMITADA), CHANGING THE FUTURE LAND USE DESIGNATION FROM LOW RESIDENTIAL 2 (LR-2) TO MULTIPLE LAND USE (MLU). THE PROPOSAL INCLUDES COMMERCIAL HIGH (CH) FOR 15.36 ACRES; COMMERCIAL HIGH OFFICE (CH-O) FOR 9.5 ACRES; LR-2 FOR 5.96 ACRES, CLUSTERED; OPEN SPACE FOR 4.0 ACRES; AND LAKE/DRAINAGE FOR 5.18 ACRES. Staff Recommendation: Transmittal with conditions as follows:

1. Development of the site shall comply with the Design Guidelines and Standards for Future Development (Exhibit 4. of this report). Architectural design guidelines, shall be submitted for review at the time the first portion of the site is submitted for certification through the zoning approval and Development Review Committee processes.

2. Of the square footage allowed under the Commercial High portion of this ordinance, a minimum of 13,000 square feet shall be restricted to uses which are allowed under the Neighborhood Commercial (CN) Zoning District. Said uses shall front on the spine road, within the pedestrian oriented zone, as depicted on the Master Plan. The maximum square footage of each said use shall be subject to the restrictions of the Neighborhood Commercial Zoning District, however, in no event shall the maximum square footage not exceed 3,500 square feet per tenant.

3. The height of the buildings on the Commercial High Office portion of the site shall be limited to a maximum of 35 feet overall.

4. At the time of re-zoning of the first portion of this site to be developed, a "unity of control" covenant for the site shall be entered into and signed by the applicant(s)/developer(s).

5. In no event shall any individual tenant within the project exceed 55,000 sq. ft. in floor area.
