I.C. REMARKS OF THE CHAIR
The Palm Beach County, Florida, Board of County Commissioners (BCC) has convened to hear and consider public
comments, pursuant to Chapter 163, Part II, Florida Statutes, Chapters 9J-5 and 9J-11, Florida Administrative Code,
and other authority, on the transmittal of Comprehensive Plan Amendment Round 00-2. This public hearing is being
held on Wednesday, July 12, 2000, at the Jane M. Thompson Memorial Chambers, Sixth Floor, 301 North Olive
Avenue, West Palm Beach, Florida. This public hearing may be continued to another time and place as necessary.
The proposed amendments to the 1989 Palm Beach County Comprehensive Plan include text amendments and site
specific amendments to the Future Land Use Atlas. Adoption of the transmitted amendments by the BCC will be in
November 2000.
The Local Planning Agency (LPA) held its public hearings on these amendments on June 9 and 16, 2000.

Planning Director Frank M. Duke informed the board that the Unified Land Development Code required staff to
announce at this meeting the schedule for Comprehensive Plan amendment rounds in 2001, part of which he then
noted.

Mr. Duke observed that a few weeks previously, the board had expressed a desire to postpone the item to Amendment
Round 01-1 and had been informed that they needed to take such action formally today.

STATE ROAD 7/CLINT MOORE
AMENDMENT TO THE FUTURE LAND USE ATLAS (FLUA) OF THE COMPREHENSIVE PLAN TO CHANGE
THE FUTURE LAND USE DESIGNATION FOR A 17.96-ACRE PARCEL LOCATED AT THE SOUTHEAST
CORNER OF CLINT MOORE ROAD AND STATE ROAD 7 (U.S. 441) FROM MEDIUM RESIDENTIAL 5 (MR-5) TO COMMERCIAL LOW WITH AN UNDERLYING 5 UNITS PER ACRE (CL/5) (OWNERS/APPLICANTS:

Staff Recommendation: Approval subject to the following conditions:
1. The eastern 250 feet of the site be cross-hatched, which limits this portion of the site to drainage, landscaping, and
at-grade parking only. Vehicular storage, and/or storage of any kind is prohibited (with the exception of drainage and
water retention, which is permitted on site);
2. The maximum gross building area of the commercial uses on the site shall be 143,750; and
3. The single largest tenant on the site shall be a grocery store, which is limited to a maximum of 55,000 square feet.
Local Planning Agency Recommendation: Approval, pursuant to staff recommendation.
Senior Planner Jim Bell noted that staff had received letters of objection from four residents of Boca Gardens planned
unit development (PUD) and two residents of Symphony Bay PUD. He referred the Board of County Commissioners
(BCC) to a letter from the Land Use Advisory Board requesting that the BCC direct the Engineering and Public Works
Department to research the possibility of installing a traffic signal one-quarter mile east of the intersection of Clint
Moore Road and State Road 7 at the entrance of Symphony Bay PUD.
PUBLIC COMMENT:
Rosa Durando objected to the continuing commercialization of State Road 7. In addition to being incompatible with
surrounding land uses, she contended, the retail commercial project with its supermarket would aggravate traffic
problems. As for the Thomas Farms Packing Plant, Ms. Durando noted that it has long served a purpose in the
Agricultural Reserve and would continue to be needed. She expressed concern that its owner might be encouraged by
the application under review to convert the packing plant site to a commercial use.
Commissioner Aaronson responded that the project would relieve traffic congestion and that with additional homes
coming into the Agricultural Reserve, there would be a need for a shopping center.
Sheri Scarborough, member of the West Boca Community Council as well as the Symphony Bay Homeowners
Association, supported the project with the proviso that Clint Moore Road be widened before the shopping center was
opened. Further, she supported a traffic signal at either Symphony Bay or the proposed shopping center.
Commissioner McCarty pointed out that the hearing was an inappropriate vehicle for a traffic signal discussion. If a
traffic signal was warranted, she said, one would be installed. Otherwise, it would not.
MOTION to transmit the State Road 7/Clint Moore amendment with conditions. Motion by Commissioner
Aaronson, seconded by Commissioner Marcus, and carried 6-0. Commissioner Newell absent.

II.A.3. APPLICATION 00-82 MLU 1
MILITARY TRAIL/HYPOLUXO ROAD
AMENDMENT TO THE FUTURE LAND USE ATLAS (FLUA) OF THE COMPREHENSIVE PLAN TO CHANGE
THE FUTURE LAND USE DESIGNATION FOR A 19.18-ACRE PARCEL LOCATED ON THE EAST SIDE OF
MILITARY TRAIL APPROXIMATELY 690 FEET NORTH OF HYPOLUXO ROAD FROM MEDIUM
RESIDENTIAL 5 (MR-5) TO MULTIPLE LAND USE (MLU) DESIGNATION (OWNER: PAUL Z. OKEAN;
APPLICANT: MORNINGSTART NURSERY). THE PROPOSAL INCLUDES: (1) COMMERCIAL HIGH OFFICE

Staff Recommendation: Approval, subject to the following conditions:
1. Development of the site shall conform with the "Design Criteria for Landscape Buffers and Pedestrian Open Space
System" (Exhibit 5);
2. The height of the buildings on the Commercial High Office and Commercial Low office portions of the site shall be
limited to a maximum of 25 feet overall;
3. The height of the building(s) on the Institutional portion of the site shall be limited to a maximum of 15 feet overall;
4. At the time of re-zoning of the first portion of this site to be developed, a "unity of control" covenant for the site
shall be entered into and signed by the applicant(s)/developer(s).
Local Planning Agency: Approval, pursuant to staff recommendation.
Senior Planner Lisa Amara Lowe said that staff had received two letters signed by several area residents, expressing
concern about the project's use and requesting certain conditions. She noted that the letters were included in the
backup.
After an extensive discussion, it was decided to address the matter of a chain link fence with enhanced buffering when
the project came forward in the zoning process. It was further decided not to add an age-restriction condition for the
congregate living facility because such a condition would preclude otherwise eligible persons from obtaining essential
assistance.
MOTION to transmit the proposed Military/Hypoluxo amendment with conditions. Motion by Commissioner
Masilotti and seconded by Commissioner Roberts.

II.B. TEXT AND MAP AMENDMENTS RELATED TO TRANSPORTATION
II.B.1. PGA BOULEVARD CRALLS
AMENDMENT MODIFYING THE TRANSPORTATION ELEMENT OF THE COMPREHENSIVE PLAN WHICH
WILL DESIGNATE SEGMENTS OF PGA BOULEVARD BETWEEN RONALD REAGAN TURNPIKE AND
PROSPERITY FARMS ROAD, INCLUDING THE INTERSECTION OF PGA BOULEVARD AND MILITARY
TRAIL, AS A CRALLS (CONSTRAINED ROADWAY AT A LOWER LEVEL OF SERVICE) FACILITY
EXCLUSIVELY FOR THE PURPOSE OF CONCURRENCY FOR THE PROJECTS WHICH ENTERED INTO A
FORBEARANCE AGREEMENT WITH THE CITY OF PALM BEACH GARDENS ON APRIL 15, 1999, TO
FACILITATE AREA-WIDE PLANNING OF THEIR IMPACTS AND FOR OTHER PROJECTS GENERATING

Local Planning Agency Recommendation: Denial.
Senior Transportation Planner Khurshid Mohyuddin said that the Land Use Advisory Board's recommendation of
denial was based on the following concerns:
Impacts on surrounding communities.
Nature of constraints.
Need for additional mitigation, such as mass transit.
Planning Director Duke said that in order to address the board's concerns, staff had developed alternatives to certain
proposed revisions to Policy 1.2-f. These revisions were included in a handout with unchanged text omitted for
brevity:
Section 18:
PGA Boulevard, from the Ronald Reagan Turnpike to Prosperity Farms Road, and the intersection of PGA Boulevard
and Military Trail are hereby designated as Constrained Roadways at Lower Level of Service
(CRALLS) facilities
exclusively for the purpose of concurrency for projects which entered into a forbearance agreement with the City of
Palm Beach Gardens on April 15, 1999 for projects developing at or below the levels permitted by their Future Land
Use designations as of December 31, 2000, which are generating less than 2,000 daily trips. All concurrency
certificates issued by Palm Beach County utilizing this CRALLS shall be conditioned to require that: 1) prior to any
building permit for the project, the funds for design, acquisition, and construction of all roads in the City Center
Linkages Plan shall irrevocably be pledged for that purpose; 2) the City of Palm Beach Gardens development order
approval ensure that those elements of the City Center Linkages Plan, as approved by the City of Palm Beach
Gardens, which are located on the site, are constructed concurrent with the development.
Section 18.c:
PGA Boulevard from Military Trail to Interstate 95 (I-95) daily level of service standard: Changed from 59,280
vehicles to 53,280 vehicles.
Mr. Duke pointed out that the revised figure was an error. Correctly, it was 50,780.
Section 18.d:
PGA Boulevard from I-95 to RCA Boulevard daily level of service standard: Changed from 76,174 vehicles to 70,174
vehicles.
Mr. Duke said the correct revised figure was actually 67,674.
Section 18.e:
PGA Boulevard from RCA Boulevard to Alternate AIA daily level of service standard: Changed from 76,555 vehicles
to 70,555 vehicles.
Mr. Duke corrected the revised figure to 68,055.
Section 18.f:
PGA Boulevard from Alternate AIA to Fairchild Gardens Avenue daily level of service standard: Changed from 62,636
vehicles to 59,636 vehicles.
Section 18.g:
PGA Boulevard from Fairchild Gardens Avenue to Prosperity Farms Road daily level of service standard: Changed
from 57,283 vehicles to 54,283 vehicles.
Section 18, paragraph between 18.h and 18.i:
The CRALLS designation on the above will be revisited if the City of Palm Beach Gardens fails to provide the County's
Planning Director a report by March 1st of each year beginning in year 2002 showing that concurrent with the
development approvals, the City: 1) has been satisfactorily moving forward with the implementation of: is requiring
the construction of the City Center Linkages Plan dated November 1999; 2) has completed an evaluation of the
feasibility of a fixed-route bus transit service to circulate within the City Center; and 3) has initiated the Hood Road
extension from Alternate AIA to Prosperity Farms Road.
Mr. Duke recommended approval of the following condition, which he explained would attach to the motion and
would not be in the Comprehensive Plan:
Prior to the County's adoption of this CRALLS, the City of Palm Beach Gardens must officially adopt the City Center
Linkages Plan as submitted as supporting data for this amendment through a public hearing process including all
affected parties and to incorporate the City Center Linkages Plan in their Comprehensive Plan through a transmittal
hearing.
Palm Beach Gardens Growth Management Director Roxanne Manning and Palm Beach Gardens Commissioner Lauren
Furtado addressed the Board. Ms. Manning agreed to the revisions.
PUBLIC COMMENT:
Rosa Durando supported the revisions.
Town of Jupiter Community Development Director Sam Shannon observed that the modifications were most positive
in taking the proposed amendment in the right direction, that he saw no significant impact from the CRALLS on the
Town of Jupiter at this point, and that the town, the city, and the county should discuss the proposed amendment at the
fall traffic forum. Commissioner Marcus said that it would be.
Neil Merin expressed marked satisfaction with the six lanes of PGA Boulevard and said it would be a shame to add two
more lanes. A CRALLS was not a bad thing, he said.
MOTION to transmit the proposed PGA Boulevard CRALLS amendment with the added condition and revised
text. Motion by Commissioner Marcus, seconded by Commissioner Aaronson, and carried 6-0. Commissioner
Newell absent.

II.B.2. GENERAL TIM AMENDMENTS
AMENDMENT MODIFYING THE TRANSPORTATION ELEMENT AND THE THOROUGHFARE RIGHT-OF-WAY IDENTIFICATION MAP (TIM) OF THE COMPREHENSIVE PLAN BY: (1) ADDING QUADRILLE
BOULEVARD FROM OKEECHOBEE BOULEVARD TO DIXIE HIGHWAY; (2) ADDING A SOUTHERN
BOULEVARD/JOG ROAD INTERCHANGE; (3) ADDING A SOUTHERN BOULEVARD/HAVERHILL ROAD
INTERCHANGE; (4) ADDING WEST PARK AVENUE FROM OLD DIXIE HIGHWAY TO CONGRESS
AVENUE; AND (5) ADDING A POLICY TO CLARIFY THE COUNTY'S STATUTORY AUTHORITY TO BUILD

AMENDMENT MODIFYING THE TRANSPORTATION ELEMENT (TE) AND THE THOROUGHFARE RIGHT-OF-WAY IDENTIFICATION MAP (TIM) OF THE COMPREHENSIVE PLAN BY: (1) AMENDING THE TIM TO
REDUCE THE RIGHT-OF-WAY FOR THE SEGMENT OF HOOD ROAD BETWEEN ALTERNATE AIA AND
PROSPERITY FARMS ROAD FROM 110 FEET TO 60 FEET WITH THE REMAINING 50 FEET TO BE USED
FOR LANDSCAPING AND BUFFERING; (2) CHANGING THE DEPICTION OF HOOD ROAD ON THE TIM TO
CONNECT TO FLAMINGO ROAD; AND (3) CREATING A NEW POLICY (TE 1.4-U) THAT WILL LIST THE

MOTION to transmit the proposed Hood Road TIM and text amendment. Motion by Commissioner Masilotti
and seconded by Commissioner McCarty.
PUBLIC COMMENT:
Tom Rice, chair of the Hood Road Committee for Frenchman's Landing Property Owners Association, said that
Frenchman's Landing, Frenchman's Creek, and Crystal Pointe had worked on impact issues for several months with
Palm Beach County, the City of Palm Beach Gardens, and Toll Brothers developers and had come to a buffering and
landscaping agreement. He contended that the agreement would be jeopardized by approval of The Sanctuary's request
for additional turn lanes into their community. Mr. Rice urged the board to stand by the agreement and do nothing to
jeopardize it.
Planning Director Duke remarked that staff might need to modify the language to ensure functioning at specific
turnabouts and intersections but would try to do so in such a way that the agreement was not compromised. The 50-foot buffer would be maintained, he said.

Raymond W. Royce, agent for Toll Brothers, supported staff's recommendations.
Robert Cotleur, landscape architect for The Sanctuary, discussed his client's plan using various measures to minimize
the impact of Flamingo Road on the community.
Andrea Greenspan, member of The Sanctuary Ad Hoc Committee to Oversee Hood Road Extension, supported
transmittal of the proposed amendment. She said that Toll Brothers had agreed to incorporate the Cotleur landscaping
plan in their planning with their landscape architect.
Commissioner Marcus expressed her hope that Toll Brothers would meet with another community that has different
issues with the development. She urged the participation of all affected communities in discussion of the project so
that each individual interest is addressed.

Michael Danchuk, president of Palm Beach Country Estates Home Owners Association, asked for assurance that
approval would in no way make it easier for a day care center to get in on Donald Ross Road at 2.5 acres as opposed to
10 acres. Planning Director Duke replied that the amendment would have no impact on the ability of the day care
center to move forward. Zoning Director William C. Whiteford concurred.

Commissioner Marcus initiated a discussion on reducing densities on residential properties, traffic modeling, and
phantom trips. She recommended that: (1) the Comprehensive Plan indicate a development's true nature once trips
have been taken away; (2) roadways reflect reduced density and associated impact fees; (3) municipalities be informed
they are responsible for amending their comprehensive plans and informing the county; (4) staff review the numbers
used in the Metropolitan Planning Organization's (MPO) modeling process and how those numbers reflect on what is in
the county's Comprehensive Plan; and (5) staff look at unbuilt properties on a case-by-case basis.
The board agreed to look, first, at Boca West and the Addison Reserve. County Engineer George T. Webb said that the
Engineering and Public Works Department would work with the Planning Division and the MPO on the 25 properties
with the most significant potential effect on what roads will need to exist and those with phantom trips. Ms. Marcus
asked Planning Director Duke to request the MPO model of Boca West from MPO Director Randy Whitfield; Mr.
Duke said he would.
