SECTION 28. ANIMAL CARE AND CONTROL HEARING BOARD.A. The Board of County Commissioners shall appoint an Animal Care and Control Hearing Board which in its judgment shall fairly represent the Division, animal owners, and the county. The Hearing Board shall make decisions relating to any hearings that have been initiated concerning dangerous dogs or vicious dogs and appeals relating to permits for a kennel, stable (private or public), pet shop, excess animal habitat, grooming establishment or private animal non-profit organization as provided for in Section 23 - KENNEL, EXCESS ANIMAL HABITAT, PET SHOP, GROOMING PARLOR, COMMERCIAL STABLE PERMITS, of this Ordinance. B. The Hearing Board shall be appointed from a slate of nominations by the Board of County Commissioners and shall be comprised of seven (7) individuals representing each of the following backgrounds: 1. Certified law enforcement officer or police K-9 handler. 2. Health department officer. 3. Licensed Florida state veterinarian. 4. Humane society officer. 5. Attorney licensed by the Florida Bar. 6. Two (2) members of the public. C. An Assistant County Attorney shall serve as the prosecuting attorney for the Division. To conduct official business, at least five (5) members of the Hearing Board must be present at a meeting. D. The Board of County Commissioners shall make reasonable rules and regulations for operational procedures of the Hearing Board. |
