ADMINISTRATIVE VARIANCES

1. Type I-A Variances
Type I-A Administrative Variances are received, and either approved or denied by the staff in accordance with the five (5) criteria stated in Article 2.D.3.G. of the ULDC. The Administrative Variance Public Meeting Staff has been delegated limited authority to approve variances with de minimis impact and may be approved with or without conditions.

Types of I-A Variances
1. Structural Encroachments into Setbacks:

a. Up to five percent of a required setback; and, up to five percent of the required number of parking spaces.
b. Up to five percent of the required number of parking spaces.

2. Preservation of Vegetation-to accommodate the preservation of existing native tree(s):

a.Up to five percent of a required setback; and
b.Up to five percent of the required number of parking spaces..

3. Native Ecosystem Overlay (NEO)
A variance may be issued from off-street parking; off-street loading, density-intensity, heights and setbacks provided the criteria are met pursuant to Art. 3.B.8, NEO Overlay District.

4. Vacant Lots
The owner of a vacant lot may be issued a variance for time frame, landscaping, and amount of coverage required pursuant to Art. 2.D.3.

2. Type I-B Variances
The Administrative Variance Public Meeting Staff may grant a variance if it is in accordance with the seven (7) criteria stated in Article 2.D.3.G. of the ULDC. Prior to applying for a variance, the applicant should seek alternative design solutions to the problem, such as reducing the size of the structure, or relocating the structure on site, etc. If alternative solutions do not exist, the applicant must meet seven (7) variance criteria.

3. Appeals
The Hearing Officer shall hear and decide appeals from interpretation or decisions of the Zoning Director, PBC Engineer, or Airport Director pursuant to the procedures and standards in Art. 2, Development Review Process. Pursuant to Article 2.A.1.S. Appeals, any person aggrieved by a decision of the Zoning Director on an application for a Type IA or Type IB administrative variance shall appeal to the Hearing Officer within 30 days of the decision.
