Background: 

Lots illegally created between February 2, 1973 and June 16, 1992, may be eligible to submit a Request for Potentially Buildable Lot Review. To be eligible, the applicant must verify that the subject parcel meets minimum lot size/dimensions; was never conveyed in whole or in part into common ownership with an abutting property; and at the time of creation, compiled with the density requirements of the Comprehensive Plan in effect at the time and had legal access (U.L.D.C. Section 1.H.1 B.1.b)

Application Intake: Application forms can be obtained from the Concurrency Section of the Zoning Division (2nd Floor - East Wing), or by fax by calling (561) 233-5042. The application requires the submission of a completed and notarized application form; and, if the application is made by someone other than the owner(s), a competed and notarized Consent Form authorizing the agent to act on behalf of the owner. In addition, the following documentation is required:

1) Current certified (signed/sealed) survey based on recent abstract of title;

2) proof of legal access; and

3) Copy of earliest recorded deed describing the subject lot.

Applications are accepted by appointment only. Please call the Concurrency Section for scheduling.

Review Fee/Time/Process: 

The review fee is $75. Staff will process a request within 10 working days, unless the application is determined to be insufficient. Approvals are required from Planning and Zoning Division staff, with final sign-off required by the Zoning Director.

Approval/Denial: 

If approved, an Affidavit of Potentially Buildable Lot is issued. The Affidavit may specify and be subject to conditions. The Affidavit must be signed (notarized) by the property owner(s) and the Zoning Director, and then be recorded in the Public Records. Proof of recording must be submitted to the Zoning Division.

The Affidavit runs with the land and remains in effect as long as the terms and conditions are met.
