On the Road (Right of Way)
Must obtain a permit from the Department of Engineering and the Division of Hotels & Restaurants if applicable. Only allowed to sell produce or plants. The Department of Transportation will not issue any permits to roadside vendors when the location is on a state road. Zoning is not required but Intent to Permit issued by the Department of Engineering must be attached with the application.
Private Property
Must obtain a letter of permission from the property owner and take it to the zoning department (city or county) for approval. Contact the Division of Hotels & Restaurants if applicable.
Mobile Vendor (Transient)
Must obtain zoning approval for base location and county zoning if operating in an unincorporated location. If you are preparing food an approval inspection from the Division of Hotels & Restaurants will be required. If you only sell whole (uncut or opened) fruits, vegetables or boiled peanuts no inspection is required. Vendors selling juices, jams or jellies will require an inspection from the Department of Agriculture and Consumer Services. Contact the zoning department of the city where you plan to operate.
Park Vendors
The Palm Beach County Parks and Recreation Department, Department of Engineering, and the Division of Hotels & Restaurants (if applicable) must sign the application for Local Business Tax Receipts.
Boynton Inlet
Issue a receipt with the appropriate approvals, Division of Hotels & Restaurants (if applicable) with zoning approval from the base location. Contact the Lake Worth Inlet District to obtain approval for the inlet location. Vendors are allowed at the inlet on a first come, first served basis. The inlet cannot be used as a business location on the receipt.
Waterway
Zoning must be obtained from the city where the food leaves the dock. Contact the Division of Hotels & Restaurants if applicable.
